JUSTICE MADHURESH PRASAD ORAL ORDER 15-12-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered for offence under sections 420, 467, 468, 471, 406, 120B, 506, 504 and 34 of the IPC and section 138 of the NI Act. Counsel for the petitioner submits that he has been implicated in this case only because he is uncle of one Arvind Kherwar who, as per the allegation made in the FIR, perpetrated the fraud by executing the agreement for sale of a land which had already been sold to some other person. Specific submission is that his nephew who had executed the agreement after taking money from the informant is traceless and the petitioner is not connected with him any way. Petitioner is in custody since 14.9.2017 having no antecedent.

The prayer for bail of the petitioner is allowed and the petitioner as mentioned above is directed be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in PS.Case No. -10 Year- 2017 Thana - DARBHANGA SADAR District- DARBHANGA on the

No.56223 of 2017 (2) dt.15-12-2017 2/2 following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
