JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Khaje Kalan P.S. case no. 137 of 2017 for the offence under Sections 147, 148, 149, 302, 201 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that similarly circumstanced co-accused have been granted bail by different Co-ordinate Benches of this Court on considering the fact that the deceased was assaulted by 25 named accused persons and 50-60 other persons with bricks, stones etc. He further submits that the petitioner has been made accused in this case on the basis of CCTV footage. .

Considering the fact that similarly circumstanced

No.54727 of 2018 (2) dt.28-09-2018 2/2 accused persons have been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna City, Patna in connection with Khaje Kalan P.S. case no. 137 of 2017.
