JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-09-2022 Petitioner in the present case has prayed for handing over the investigation of Buniyadganj P.S. Case No. 04 of 2019 registered under Sections 302, 201, 120B, 354, 354(B) of the Indian Penal Code, Section 8 of POCSO Act and Section 75 of the J.J. Act to some independent agency or the Central Bureau of Investigation. It is submitted that the petitioner belongs to a very poor family. It is alleged that the local police is under the influence of the miscreants and under such circumstance, the petitioner is looking for an independent investigation. The petitioner submits that his minor daughter has been murdered in a different manner but local police under influence of the suspects who are adamant to prove the case of honour killing by ignoring the over-

A counter affidavit has been filed in this case wherein the Senior Superintendent of Police, Gaya has stated that the police has conducted investigation and a proper investigation has been conducted in which the truth has been unveiled. It is submitted that the case has been found true against three accused persons namely Turaj Prasad @ Nina, Leela Patwa and Kuleshwari Devi and accordingly a charge-sheet bearing no. 32 of 2019 dated 31.03.2019 has been filed.

In the given facts and circumstances of the case, from the averments present in the counter affidavit, this Court finds no specific reason to transfer the investigation to any other agency particularly when the charge-sheet has already been filed. If the petitioner is looking for further investigation, he may seek his remedy in the court below in accordance with law. This application stands disposed of accordingly.
