2. The petitioner is apprehending his arrest in Trial No. 655 of 2024 arising out of Complaint Case No. 03 of 2018 registered under Section 409 of the Indian Penal Code.

3. The matter relates to the loss of government revenue due to laches and carelessness of the accused persons.

4. At the outset, learned counsel for the petitioner has fairly submits that the petitioner is ready to deposit the entire money amounting to Rs. 9,98,000/- if sometime is provided to him.

5. Learned APP has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks, be released on anticipatory bail provisionally for a period of four months on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari in connection with Trial No. 655 of 2024 arising out of Complaint Case No. 03 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.

7. Out of Rs. 9,98,000/- the petitioner will deposit an amount of Rs. 3,50,000/- (Rs. Three lacs and fifty thousand only) at the time of furnishing bail bonds. The petitioner will deposit the rest amount i.e. Rs. 6,48,000/- (Rs. Six lacs and forty eight thousand only) in further three equal monthly installment.

8. It is made clear that only after payment of the whole amount of Rs. 9,98,000/-, the provisional bail granted to the petitioner shall be confirmed by the learned court below itself.
