JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant.
The petitioners seek bail in connection with Hayaghat P.S. Case No.57 of 2018 registered under Sections 341, 323, 324, 504, 307 and 302/34 of the Indian Penal Code. The accusation is that due to causing of assault by Md. Rajaullah through fists on the chest of the informant Danish, the informant Danish and his father Md. Mumtaz went at the house of Md. Rajaullah to make complain, then Md. Rajaullah started to abuse and gave dagger blow at the
Patna High Court Cr.Misc. No.53922 of 2018(2) dt.19-09-2018 2/3 informant, causing slight injury at his chest. Thereafter, Md. Rajaullah again caused injury at the chest of the informant through dagger. When Md. Mumtaz, the father of the informant, rushed to save the informant, then the petitioners caught hold of his father. Thereafter, Md. Rajaullah gave dagger blow at the chest of the father of the informant, who became unconscious. At that time, the petitioners also caused injury to him through fists. The father of the informant, later on, died in course of treatment.
Learned counsel appearing on behalf of the petitioners submits that as the petitioners are family members of the main accused Md. Rajaullah against whom there is allegation of causing injury through dagger at the chest of the deceased, the father of the informant, due to that reason, the petitioners have falsely been implicated in this case. It is further submitted that the petitioners are in custody since 05.06.2018 and have no criminal antecedents.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga at
