JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Dhaka P.S. Case No. 152 of 2016, disclosing offences under Sections 364, 365/34 of the Indian Penal Code. Allegation is of abduction of the minor son of the informant. Petitioner is not named in the F.I.R., later on his name transpires on the confessional statement of the co-accused persons.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Except the confessional statement of the co-accused, nothing against the petitioner. He is an accused in one more case. Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above, and also of criminal antecedent, I am not inclined to grant privilege of anticipatory bail to the
Patna High Court CR. MISC. No.20407 of 2019(3) dt.19-06-2019 2/2 petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned trial court, without being prejudiced by order of this Court.
