Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Complaint Case No. 855 of 2005 for the offence punishable under Sections 323, 498-A of the Indian Penal Code. At the very outset, learned counsel for the petitioner has submitted that the petitioner is ready to pay maintenance amount of Rs.7,000/- per month to the opposite party no.2, who has been deserted by the petitioner. Considering the aforesaid, this anticipatory bail application is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, XIV, Bhagalpur, in connection with Complaint Case No. 855 of 2005, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The petitioner shall regularly pay the maintenance amount of Rs.7,000/- per month in the bank account of opposite party no.2 beginning from March, 2022. The bank account details shall be given by opposite party no.2 to the learned counsel for the petitioner. Any default in payment of maintenance amount of Rs.7,000/- by 10th of every month, shall result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
