12-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Sitamarhi P.S. Case No. 876/2017, G.R. No. 4441/2017 registered for the offence punishable under Sections 420, 379 of the Indian Penal Code and Section 66(c) of I.T. Act, pending in the court of Chief Judicial Magistrate, Sitamarhi.

Learned counsel for the petitioner submits that the seizure list in the present case has been prepared on the basis of the recoveries which were shown to police by the informant. It is in the nature of a production cum seizure list. On perusal of the F.I.R. and seizure list, it is found that the petitioner was allegedly one of the three persons who

No.169 of 2018 (2) dt.12-01-2018 attempted to flee away from the place of occurrence on being noticed by the informant, but the petitioner was caught hold of and from his possession a cash amount of Rs. 19,000/- and several debit and credit cards of unknown persons were recovered.

In the facts and circumstances of this case considering that the investigation in the present case is still going on, I am not inclined to grant regular bail to the petitioner at this stage.

This application is, accordingly, dismissed.
