JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.
According to informant, Supervisor Sanjay Kumar was working in the site of Garha village where construction of Muzaffarpur Sonbarsa N.H.-77 North Bihar Highway was going on. Four motorcycle borne miscreants came there and fired upon Sanjay Kumar, who died in course of treatment. It has been submitted on behalf of the petitioner that he is in custody since 10.8.2015. Chargesheet has been submitted against petitioner. Charge has been framed in the present case. No allegation of tampering of witnesses is alleged against petitioner. In course of investigation suspicion has been raised against petitioner regarding his involvement in the present case. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest his implication in the present case.
On behalf of the State, it is submitted that there is strong suspicion in the present case. There are as many as 15 cases
Patna High Court Cr.Misc. No.34381 of 2016 (3) dt.30-09-2016 2/2 pending against petitioner.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
