2. The petitioner has prayed for bail in connection with Paura P.S. Case No. 47 of 2025 registered for the offence punishable under Sections 80 and 3(5) of B.N.S.
3. The case of the prosecution, in short, is that the sister of the informant, namely, Savita Kumari (deceased) was married in the year 2022 with this petitioner. It is further alleged that she was being subjected to cruelty on account of nonfulfillment of dowry demand of a bike and Rs. 50,000/- in cash. On 22.10.2025 at 2.30 A.M., the informant received information that the deceased has been killed by her in-laws. When the informant and his family members reached the matrimonial house of the deceased, they found the deceased lying dead in the

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. it is clear that as per allegation, she was being assaulted and was throttled but from perusal of the postmortem report it is clear that the board of doctors conducting autopsy of the deceased have found following antemortem injury:- One incomplete oblique ligature mark measuring 9"x 1/2" was seen over front of neck above thyroid cartilage going upward and backward up to the right mastoid region up to the left mastoid region.
Learned counsel for the petitioner has further submitted that according to the board the cause of death is asphyxia as a result of hanging. It has further been submitted that as per the F.I.R., there is allegation of assaulting and throttling whereas the postmortem report is otherwise. It has also been submitted that when the informant came to know about the real facts, he has filed a petition before the learned trial Court that his sister was suffering from some mental ailment and that she has committed suicide. Petitioner is having no criminal antecedent and he is

5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Paura P.S. Case No. 47 of 2025. (Ashok Kumar Pandey, J) lata/- U T
