The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 448, 354, 435, 504/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
It is alleged that co-accused Samodh Singh put pistol on the head of the informant and abused by calling caste name and put the hutment on fire, whereas coaccused Kanhaiya Singh tore the blouse of the informant. Co-accused Amit Singh snatched gold chain of the informant.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.36310 of 2015 (2) dt.08-09-2015 petitioner that accusation under S.C./S.T. is specific against co-accused Samod Singh, whereas the co-accused Amit Singh has been granted bail vide Cr. Misc. No. 2262 of 2014. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P.S. Case No. 30 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
