JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 The present application has been filed for modification of the order dated 13.11.2014 passed in Cr. Misc. No. 21123 of 2014 whereby the petitioners' application for anticipatory bail was disposed of since the petitioner was granted anticipatory bail by learned Sessions Judge vide order dated 27.09.2013 passed in A.B.P. No. 537 of 2013. but the petitioners could not surrender to execute the bail bonds and thereafter the petitioners filed another anticipatory bail application vide ABP No. 1956 of 2013 which was rejected by learned Sessions Judge vide order dated 16.01.2014. Thereafter the petitioner moved this Court vide Cr. Misc. No. 21123 of 2014 but the same was also disposed of as not maintainable.
Patna High Court Cr.Misc. No.5589 of 2015 (5) dt.14-07-2015 2/2 This Court is not inclined entertain the present modification application.
Let learned court below to consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks keeping in view that on merit the petitioner was granted anticipatory bail in connection with Town P.S. Case No. 333 of 2011 pending in the court of learned CJM, Muzaffarpur. It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.
