JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323,341,504 and 379/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The accusation is of making assault and abusing by calling caste name. It is specifically alleged against the petitioner that she took out silver chain from the neck of Anita Devi. It is submitted by the learned counsel for the petitioner that for the occurrence of 24.5.2015 the FIR was registered on 26.5.2015 and specific accusation against the petitioner is only of
Patna High Court Cr.Misc. No.34057 of 2015 (2) dt.24-08-2015 2/2 snatching the silver chain. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and the petitioner being lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with SC/ST P.S. Case No. 56 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
