2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Kundwachainpur P.S. Case No. 222 of 2025 registered for the offences punishable under Sections 7 of E.C. Act.
3. The allegation against petitioner is to keep 168 bag of Urea fertilizer for the purpose of black marketing.
4. It is submitted by learned counsel appearing on behalf of the petitioner that admittedly the petitioner is a PDS dealer and as the "Urea" received by him few days back only, it was not entered with "POS Machine" reflecting stock. It is submitted that for said irregularities only it was suspected that petitioner might involve in black marketing of Urea and therefore the entire implication is based upon
Patna High Court CR. MISC. No.19149 of 2026(2) dt.31-03-2026 2/2 suspicion. Explaining criminal antecedents, it is submitted that petitioner found involved in four more criminal cases, where he is on bail.
5. Learned APP opposes the prayer of bail.
6. In view of aforesaid factual submission and by taking note of fact as prima-facie on the basis of suspicion that petitioner may commit black-marketing, his implication appears made with present case, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dhaka East Champaran, Motihari /concerned Court, where the case is pending in connection with Kundwachainpur P.S. Case No. 222 of 2025, subject to the conditions as laid down under Section 482(2) of BNSS.
