2. The petitioner has preferred this application for grant of regular bail in connection with Turkauliya P.S. Case No. 215 of 2019 dated 02.04.2019 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 307, 332, 333, 224, 225 and 353 of the IPC and Section 45 of the Bihar Prohibition and Excise Amendment Act.

3. As per the prosecution case, the co-accused persons was arrested under the influence of liquor and the petitioner and other co-accused persons focefully got the co-accused released from the police custody and assaulted the police personnel with sticks, bricks, stones and axes.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is no specific allegation of assault against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran in connection with Turkauliya P.S. Case No. 215 of 2019.

7. The application stands allowed.
