JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-09-2022 At the outset, counsel for petitioners seeks permission to withdraw the anticipatory bail application with respect to Jai Ram Vishwakarma petitioner no. 3.

Permission is granted. The anticipatory bail application with respect to petitioner no. 3 is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioner nos. 1 and 2 apprehend their arrest in a case registered for the offences punishable under Sections 307,

Patna High Court CR. MISC. No.20583 of 2022(2) dt.01-09-2022 2/3 379, 354(B) and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner no. 1 assaulted the husband of informant on the back and hand. Petitioner no. 2 assaulted on the head of informant causing head injury. Petitioner no. 3 assaulted on left hand of the informant. It is submitted that injuries caused by petitioner nos. 1 and 2 are simple in nature. There is case and counter case. Both sides sustained injuries. Petitioner claims clean antecedent. Considering the nature of injury and clean antecedent, the petitioner nos.

1 and 2 above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 205 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
