JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioners, informant and the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/324/325/307/147/149/379/504 of the Indian Penal Code. It is specifically alleged that co-accused Antu Ram and Pappu Ram assaulted on the head of the informant with iron rod and, thereafter the other accused persons also assaulted the informant. It is further alleged the accused persons robbed mobile from the informant and gold chain from the wife of the informant. It is submitted by learned counsel for the petitioners that only injury on the left frontal bone of skull has been found to be grievous in nature but the same was alleged to be caused by

Patna High Court Cr.Misc. No.34692 of 2015 (2) dt.17-08-2015 2/2 Antu Ram and Pappu Ram. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by learned counsel for the informant that the accusation of assault is also against the petitioners. Considering the fact that accusation against the petitioners is not corroborated by the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Tiar P.S. Case No.29 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
