The petitioners in the present case are seeking anticipatory bail in connection with Jokihat (Mahalgaon) P. S. Case No. 118 of 2018 registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 354, 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that from the fardbeyan it would appear that there are general and omnibus allegation against all the petitioners except the petitioner no. 1 against whom the allegation is that he had given a blow on the face of the informant by iron rod.

Patna High Court Cr.Misc. No.54553 of 2018(2) dt.08-10-2018 2/2 Learned counsel further submits that so far as the petitioners are concerned, they have got no criminal antecedent and have been falsely implicated only because of the dispute over taking water from the hand pump.

No one has opposed the application for bail.

Considering the facts and circumstances wherein except the petitioner no. 1 there is no specific allegation of assault against petitioner no. 2 to 7, let the petitioner nos. 2 to 7 above named in case of their arrest or surrender in connection with Jokihat (Mahalgaon) P. S. Case No. 118 of 2018 within a period of four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.

So far as prayer of anticipatory bail of petitioner no. 1 is concerned, the same is rejected.
