The petitioner seeks bail in Kanhauli P.S. Case No. 93 of 2015 instituted for the offences under Sections 363, 364(A)/34 of the Indian Penal Code and Sections 25(1-B)a, 26 of the Arms Act.
Allegation has been made that three persons kidnapped eight years old boy of the informant but one person, namely, Hari Kishore Rai, was caught at the spot who has disclosed the name of Tulshi Das and present petitioner. Tulsi Das has been granted bail by this Court vide Cr. Misc.3673 of 2016.
From the record it appears that petitioner is in jail
Patna High Court Cr.Misc. No.27086 of 2016 (2) dt.15-07-2016 since 7.5.2016 and process under Sections 82 and 83 of the Code of Criminal Procedure was issued against him. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail for the present. Accordingly the prayer for bail is rejected. However, the petitioner will be at liberty to renew his prayer for bail after completion of seven months in jail custody.
