JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272/273 of the Indian Penal Code and Section 47(a) of the Excise Act.
Petitioner is in jail custody since 18.4.2016 on the accusation that 27 litres country made liquor were recovered from the grocery shop of the petitioner.
Submission on behalf of the petitioner is that the present case is plantation of police and as a matter of fact, nothing has been recovered from the shop of the petitioner. It is further submitted that moreover, petitioner does not have any criminal antecedent and the investigation of this case has already been

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-Xth at Gaya in connection with Fatehpur P.S. Case No.105 of 2016.
