The petitioner seeks bail in Danapur Rail P.S. Case No. 130 of 2018, instituted for the offence under Section(s) 25(1-b)a and 26 of the Arms Act.
As per written report, the petitioner was travelling in the Sharamjivi Express. The informant got suspicious and made search of the petitioner. One country made pistol with one live cartridge, one small knife and Rs.1,870/- have been recovered from his possession.
Counsel for the petitioner submits that from the seizure list it appears that seizure has been made in the running train of Sharamjivi Express of Coach No. S/11 near berth No.7. The seizure list does not show any recovery of firearms from
Patna High Court CR. MISC. No.18578 of 2019(4) dt.31-07-2019 2/2 conscious possession of the petitioner.
Petitioner is in custody since 8.12.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Patna, in connection with Danapur Rail P.S. Case No. 130 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
