The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366/34 of the Indian Penal Code.

Accusation is of kidnapping the minor sister of the informant.

It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 14 years, the Court also assessed her aged 14 years, where she stated that the petitioner abducted her. It is submitted that the victim returned on the same day and after her return First Information Report was lodged, but this fact has been concealed by the informant in the F.I.R. that the victim has returned.

Patna High Court Cr.Misc. No.34108 of 2015 (2) dt.24-08-2015 Considering the fact that the victim has been found to be minor, this Court is not inclined to grant anticipatory bail to the petitioner.
