Petitioner seeks bail in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Though the victim has alleged her kidnapping by the petitioner and others. The, perusal of her statement under Section 164 Cr.P.C. would reveal that she travelled to different places including Katihar and Delhi along with the kidnapper. However, did not make any protest and she has not alleged anything more against anyone.

Submission is that the matter is of love affairs with the petitioner. Petitioner is in custody since 13.09.2017. Investigation of the case is already complete and petitioner is

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Thakurganj Police Station Case No. 26 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
