Petitioner seeks bail in a case registered under Sections 147, 149, 337, 338, 307, 295, 332, 120B, 353, 188/153A, B, C and 173 of Indian Penal Code.

Petitioner submits that the first information report has been lodged by the SHO with the allegation that large number of persons including the petitioner have indulgd in violence during immersion of Durga idol. Petitioner submits that he is a rickshaw puller and is innocent and was only a bystander. He is in custody since 03.10.2017. Other accused persons have been granted bail such as Md Imroz Alam @ Imroz Alam in Cri Misc No 61761 of 2017. Prior to the instant case, there is no criminal antecedent of the petitioner.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Jamui Police Station Case No 321 of 2017 subject to the following conditions: (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
