This application has been filed for the following reliefs:- "For quashing the notice dated 24.01.2023 issued under section 3 of Bihar Public Land Encroachment Act, 1956 issued under the signature of Circle Officer, Sherghati, District: Gaya (Respondent No.3) in Encroachment Case No. 01/2023, whereby and whereunder the Circle Officer directed the petitioners to remove the encroached land bearing Mauja: Sherghati, P.S. No. 762, Khata No. 968, Plot No. 463 with different areas mentioned in respective notices under the name of writ petitioners, which have been said to have encroached by the petitioners and further directed to appear before the office of undersigned with documents on 07.02.2023, otherwise the encroached land/house have been removed under proceeding of the Act."

3. Learned counsel for the State submits that Petitioners are some of the encroachers. Though they have been issued

Patna High Court CWJC No.4956 of 2023(3) dt.22-11-2023 3/3 notice in Encroachment Case No. 01 of 2023 but they have not appeared before the authorities.

4. In these circumstances, learned counsel for the petitioners prays for and is granted to permission to withdraw this application to participate in the Encroachment Case No. 01 of 2023 pending before the Circle Officer, Sherghati, Gaya.

5. The Circle Officer, Sherghati, Gaya shall also consider all the pleas raised by the petitioner.

6. With the aforesaid observation and direction, this application is disposed of.
