"i) A writ of mandamus directing the respondents for immediate payment of difference of Gratuity and leave encashment payable to the petitioner who is the widow of the deceased employee of the bank namely Girindra Kishore Verma along with interest may be issued.

ii) A writ of certiorari to quash the order dted 10/09/13 as contained in Annexure- whereby and where under the respondent no.3 has illegally and arbitrarily rejected the application for payment of amount of ex gratia on the ground of delay may be issued.

iii) A writ of mandamus directing the respondents to make payment of arrears of salary of the deceased

Patna High Court CWJC No.10392 of 2015 (2) dt.21-07-2015 2/2 employee accruing on account of his pay revision to the petitioner may be issued."

It appears that though the petitioner has been paid the retiral benefits but there is a dispute with regard to the amount as the same has not been fixed considering the pay revision of the late husband of the petitioner.

In above view of the matter, this writ application is being disposed of with a direction to the petitioner to approach the respondent no.2, i.e., the Chairman, Uttar Bihar Grameen Bank by filing a detailed representation setting out his claim along with a copy of this order. On such representation having been filed by the petitioner, let the same be examined and decided by the respondent no.2 within a period of eight weeks from the date of filing of representation. If the petitioner is found entitled for payment then the same should be made to her within a further period of six weeks. In case, her claim does not find favour with the respondent no.1 then the respondent no.1 would be required to pass a reasoned order.
