The petitioner seeks bail in connection with Fatuha P.S. Case no. 357 of 2017 registered under Section 30(A) of Bihar Liquor Prohibition and Excise Act-2016. 79.2 ml of country made liquor is said to have been recovered from the house of Manoj Paswan and on the basis of confessional statement of Said Manoj Paswan, the petitioner has been implicated in the case as supplier of the said liquor. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has no concern either with

He has falsely been implicated in the case by Manoj Paswan due to animosity and grudge. He has no criminal antecedent. The petitioner has been languishing in custody since 11.10.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Spl. Judge Excise Act, Patna in connection with Fatuha P.S. Case no. 357 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
