This application has been filed for quashing the entire proceeding of the Complaint Case No. 27472(C) of 2014 wherein cognizance taken under Sections 323, 504 and 379 of the Indian Penal Code and Section 3(i)(x) of the S.C./S.T. by order dated 4.09.2014 passed by learned J.M. 1st Class, Patna. Learned counsel for the petitioner has drawn the attention of this Court to a petition filed in the court below wherein the informant has categorically stated that he does not want to proceed against the petitioner as they are not the real offender and due to mistake their names have been given in the complaint petition.

In view of the aforesaid circumstances, this
