The petitioner seeks bail in connection with Bihariganj P.S. Case No. 314 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act.

25 lts. of country made liquor is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has no concern with the seized liquor. The petitioner happens to be poor farmer and has been falsely implicated in the case due to ulterior motive. The petitioner has been languishing in custody since 07.11.2017.

No.1681 of 2018 (3) dt.24-01-2018 2/2 In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 314 of 2017.
