====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Manihari P.S. Case No. 144 of 2021 lodged under Section 498A and 306 of the Indian Penal Code.

The prosecution case is that the mother of the deceased has lodged this case that her daughter who has having one son and one daughter committed suicide about which information was communicated to her by his son-in-law i.e. husband of the deceased himself.

Learned counsel for the petitioner submits that the marriage was solemnized in 2013 itself and due to marital relation, they have two kids. His wife has committed suicide about which he himself provided information everywhere and

It has also been submitted that charge sheet has already been filed in this case and petitioner has no criminal antecedent. It has been mentioned further that for those two children, petitioner is only guardian. Learned counsel for the State opposes the prayer for bail and submits that case diary is necessary in this case. In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S. Case No. 144 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. The petitioner is directed to appear before the lower Court on each and every date, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond.
