JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,506,420 and 406 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the petitioner took thirty two thousand rupees for getting a loan of rupees ten lacs sanctioned in favour of the informant. On demand being made for return of the amount the informant was assaulted and abused by calling caste name. It is submitted by the learned counsel for the petitioner that the informant took jewellery from the shop of the petitioner
Patna High Court Cr.Misc. No.33303 of 2015 (2) dt.26-08-2015 2/2 and on demand of due amount, frivolous accusation has been levelled and there is no proof with regard to the payment of thirty two thousand rupees to the petitioner. It is further submitted that as per own admission of the informant, it was informant who went to the shop of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with SC/ST P.S. Case No. 67 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
