Scorpio laded with wine occupied by Vijay Choudhary and Shivam Kumar was seized by the informant, A.S.I. of Chorout O.P. It is further evident that on interrogation, apprehended accused disclosed that the articles, so seized, belonged to Rajiv Rai and his brother Sanjeev Rai (Petitioner) is involved in the business along with Raju Choudhary and Nawal Sahni. It has also been disclosed that as per instruction of Rajiv Rai, they were carrying the wine to the place of Raju Choudhary, during midst thereof, apprehended, others managed to escape. Name of petitioner has cropped up on the basis of inculpatory extra-judicial confessional statement of co-accused
Patna High Court Cr.Misc. No.54304 of 2018 (02) dt.20-09-2018 without any recovery having no criminal antecedent, appears to be good ground for the petitioner to seek regular bail, which the learned lower Court will consider favourably.
