JUSTICE SATYAVRAT VERMA ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner, learned counsel for the complainant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is the husband and is willing to keep the complainant with dignity and honour. Learned counsel for the complainant submits that he has instructions to make submission that even the complainant

Patna High Court CR. MISC. No.19493 of 2022(3) dt.17-10-2022 2/3 is willing to accompany the petitioner and resume a peaceful conjugal life.

Since the parties have shown their willingness to resume their relationship, as such the learned counsel for the petitioner submits that petitioner who presently is staying in Delhi will come and fetch the complainant from her home and take her back to Delhi where he is presently working, it is next submitted that petitioner on 16.11.2022 shall go to the house of the complainant personally to bring her back to the matrimonial home.

Learned counsel for the complainant submits that she will willingly accompany the petitioner to Delhi when he comes to fetch her.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the parties, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court

Patna High Court CR. MISC. No.19493 of 2022(3) dt.17-10-2022 3/3 in connection with Complaint Case No. 810 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Further, in case the complainant files an application before the learned trial court bringing to its notice that the petitioner, despite assuring this Court, did not come to bring her back to her matrimonial home on 16.11.2022, the learned trial court shall cancel the bail bonds of the petitioner after giving him an opportunity of hearing.
