Petitioner is languishing in custody since 19.03.2016 in a case registered for the offences punishable under Section 20 of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that from the house of the petitioner 4.1 K.g ganja were recovered, leading to registration of the present case.

It is submitted by the learned counsel for the petitioner that recovery, if at all, has been made from the joint family house of the petitioner. The investigation has already concluded. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Learned counsel for the State, Mr. Ram Sumiran

Patna High Court Cr.Misc. No.27636 of 2016 (3) dt.02-08-2016 Roy, does not controvert the quantity of recovery. Considering the recovery between the small and commercial quantity, keeping in view of the statement made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S. Act, VaishaliCum-District and Sessions Judge, Vaishali at Hajipur in connection with Goraul (Kathara O.P.) P.S. Case No. 59 of 2016.
