The petitioners seek regular bail in connection with Amba P.S. Case No. 126 of 2017 for the offences punishable under Section 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 200 Ml x 280 and 200 Ml x 300 illicit liquor from the motorcycle being driven by the petitioners herein.

The learned counsel for the petitioner submits that the fact is that no recovery has been made from the person of the petitioners, the petitioners have a clean antecedent and are in

Patna High Court Cr.Misc. No.62905 of 2017 (2) dt.17-01-2018 2/2 custody since 1.10.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have a clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum- Special Judge (Excise), Aurangabad in connection with Amba P.S.
