None ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 06-09-2022 Heard learned counsel for the petitioner. However, no one appears on behalf of the opposite party.
The petitioner is the wife of the opposite party, namely, Kumar Gaurav Dikshit, who has filed this application for transfer of Matrimonial Case No. 52/2020 from the Principal Judge, Family Court, Madhubani to any competent Court at Patna.
It has been submitted by the leaned counsel for the petitioner that the notice has been received by the uncle of the opposite party and his uncle is living in joint family in the same house.
Considering the same, the service of notice is treated to have been served validly.
Patna High Court MJC No.1085 of 2021(3) dt.06-09-2022 2/2 In view of the above, the Matrimonial Case No. 52/2020 is directed to be transferred from the Principal Judge, Family Court, Madhubani to Principal Judge, Family Court, Patna.
After transfer of the case in the Court of Principal Judge, Family Court, Patna, the Principal Judge, Patna, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Patna.
Let a copy of the order be communicated to the District Judge, Madhubani as well as to the District Judge, Patna through FAX and e-mail forthwith.
With the aforesaid observation and direction, this application is allowed.
