JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 18.07.2018 in connection with Excise Case No.30 (a) of Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He is in custody since 18.07.2018. He submits that the seizure list was not prepared in accordance with the mandatory provision of Section 100 of the Cr.P.C. He submits that he has been falsely implicated in this case due to village politics. In fact the alleged seizure of the liquor was made from an open space, connected to public road and river and as such false allegation has been levelled against the petitioner in
Patna High Court Cr.Misc. No.54422 of 2018 (2) dt.20-09-2018 2/2 the instant case without any material.
Considering the totality of the facts and circumstances of the case, let the petitioner named above is directed to be released on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge-cum-Special Judge, Excise, Samastipur, in connection with Excise Case No.208 of 2018.
