JUSTICE BIRENDRA KUMAR ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Ujiyarpur P.S. Case No. 110 of 2017, a case under Sections 461/379/511/414/353/307/34 of the Indian Penal Code and Sections 25(1-b)A/26/27/35 of the Arms Act.

The petitioner and others were apprehended at the spot when they were attempting to commit theft by cutting the lock/gate.

Submission of the learned counsel for the petitioner is that the petitioner has got no criminal antecedent and some other co-accused have been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.54094 of 2017.

Patna High Court Cr.Misc. No.58234 of 2017 (2) dt.12-12-2017 P2/ Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ujiyarpur P.S. Case No. 110 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
