The petitioner seeks bail in Excise Case No. 164/2018, arising out of P.R. No. 11 instituted for the offence under Section 30(ka) of Bihar Prohibition and Excise Ac, 2016. Learned counsel for the petitioner has submitted that petitioner is in custody since 26.07.2018. He has no criminal antecedent. As per prosecution case, alleged illicit foreign liquor has been seized from the open road, which was covered with grass. It is further alleged that petitioner was caught by the police merely on suspicion while he was running away seeing the police party.

Considering the aforesaid fact and circumstances,

Patna High Court Cr.Misc. No.56646 of 2018 (2) dt.28-09-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th A.D.J., Saran at Chapra in connection with Excise Case No. 164/2018, arising out of P.R. No. 11, subject to the conditions that both the bailors shall be the close relative of the petitioner.
