JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail on behalf of the petitioners as they apprehend their arrest in a case registered for the offences punishable under Sections 341, 323 and 504/34 of the Indian Penal Code and 3(1) (X) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act.

Drawing my attention to the First Information Report, learned counsel appearing on behalf of the petitioners submits that because of petty dispute between the parties, the occurrence is said to have taken place and the

He further submits that no offence, under Section 3(1) (X) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, is made out.

Keeping in view the submission as made on behalf of the petitioners, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Sadar S.C./S.T. P.S. Case No. 24 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
