The petitioners seek bail in a case registered under Section 394 of the Indian Penal Code.

The prosecution case, in short, is that in course of going to Chapra by motorcycle, three miscreants intercepted him and looted Rs. 20,000/- mobile and motorcycle. It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 20-08-2019. Charge sheet in this case has already been submitted. The petitioners are not named in the FIR. Their name transpired in

Patna High Court CR. MISC. No.19001 of 2019(2) dt.12-04-2019 2/2 this case on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from possession of the petitioners. It has further been submitted that the petitioners may be released after completion of nine months in custody.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Saran at Chapra in connection with Saran (Chapra) Muffasil P.S.
