JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught on the spot while, allegedly, he was making firing by his rifle and it is alleged that one country made rifle containing four live cartridges were recovered from his conscious possession. Petitioner is in jail custody since 02.03.2016 and except the present case as well as one Gogri P.S.Case No. 196 of 2013, petitioner does not have any criminal antecedent. Submission on behalf of the petitioner is that the present case is nothing but is only a highhandedness of the police and, moreover, investigation against the petitioner has already been completed.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.34456 of 2016 (2) dt.20-08-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S.Case No. 43 of 2016.
