JUSTICE BIRENDRA KUMAR ORAL ORDER 06-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Forbesganj (Simraha) P.S. Case No.670 of 2017, a case under Section 395 of the Indian Penal Code.

Some unknown persons allegedly robbed to the informant.

The petitioner has stated on oath that he has got no criminal antecedent. On suspicion, he was remanded in this case on 11.09.2017. However, he was never put on Test Identification Parade during investigation. Some cash was allegedly recovered from the house of petitioner, which was personal property of the petitioner and the same was also not put on Test Identification

Patna High Court Cr.Misc. No.57878 of 2017 (4) dt.06-02-2018 2/2 Parade. The recovered mobile was also of the petitioner. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
