JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 354, 323, 380 and 448 of the Indian Penal Code.

The prosecution case is that the petitioner entered into the room of the informant and tried to outrage her modesty and when alarm was raised, her husband came there then the accused persons including the petitioner assaulted the informant and her husband when co-accused Veena Devi snatched gold chain and Shiva Kumar took away suitcase.

It is submitted by learned counsel for the petitioner that for the occurrence of 24.08.2014, the complaint was filed on 27.08.2014 which came to be registered as a police case on 16.01.2015 whereas the petitioner lodged Mohammadpur P.S.

Patna High Court Cr.Misc. No.34216 of 2015 (2) dt.17-08-2015 2/2 Case No. 332 of 2014 against the husband of the informant, hence as a retaliatory measure, the present case has been lodged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Muzaffarpur in connection with Kazimohammadpur P.S. Case No. 34 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
