ANJANA MISHRA ORAL ORDER 20.08.2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Chakia P.S. Case No. 219/2014 registered for the offences punishable under Sections 448, 341, 323, 324, 504, 506, 307 and 379/34 of the Indian Penal |Code.

Learned counsel for the petitioners submits that the informant and petitioner no. 1 are full brothers and the dispute between them is with regard to properties as a result of which both the parties have filed cases on the same day making allegation against each other of Marpit also. It appears that some altercation may have taken place but the injuries have been described such that they may be fatal.

Patna High Court Cr.Misc. No.33001 of 2015 (2) dt.20.08.2015 Considering the aforesaid submissions and also the fact the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Motihari in connection with Chakia P.S. Case No. 219/14, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
