The petitioner is seeking regular bail in Kankarbagh P.S. Case No. 148 of 2017 registered under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that the F.I.R. is against unknown. It is alleged that the informant, who happens to be a passenger, boarded a tempo at Mithapur Bus Stand and from there while he was going towards Karbigahia he was looted by three passengers, who were already there in the tempo. Learned counsel submits that the name of the petitioner has transpired in the confessional statement of the co-accused of Guddu @ Terena. Learned counsel further submits that till date no
Patna High Court Cr.Misc. No.63768 of 2017 (2) dt.11-01-2018 2/2 T.I. Parade has been conducted to identify the petitioner and nothing has been recovered from his possession. Learned A.P.P. representing the State opposed the prayer for bail.
Considering the facts and circumstances, let the petitioner, namely, Md. Arman, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Smt. Madhvi Singh, Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 148 of 2017 subject to the conditions as laid down under Section 437(3) Cr.P.C.
