2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 123 , 103

(1) 3 (5) of the BNS.

3 . As per written report of informant, it is alleged that all the F.I.R. named accused persons including these petitioners administered poison to husband of informant due to which he died. It is further alleged that reason of the occurrence is land dispute . The occurrence is alleged to have taken place at about 06:30 - 07:00 hours on 31.08.2024 while the deceased was returning to his house after doing Majdoori and the same

Patna High Court CR. MISC. No.17711 of 2025(4) dt.09-07-2025 2/3 fact was disclosed by deceased during course of treatment at JJKT Medical College & Hospital.

4. It is submitted on behalf of the petitioners that informant is not eye witness to the alleged occurrence and only suspicion has been raised against this petitioner. The alleged occurrence took place on on31.08.2024 but F.I.R. has been lodged on 09.09.2024 i. e ,. after delay of 9 days for which there is no plausible explanation which itself casts serious doubt over the veracity of the prosecution case . However, during course of investigation , it has come that husband of informant was a habitual drinker of liquor and he died due to drinking low quality liquor. There is no direct or indirect material has come against these petitioners to show their complicity in the alleged occurrence . None of the witnesses claimed to have seen these petitioners committing the alleged occurrence . Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on

No.17711 of 2025(4) dt.09-07-2025 3/3 furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Udakishunganj Madhepura in connection with Gwalpara (Arar OP) P.S. Case No. 184 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
