The petitioner is apprehending his arrest in a case registered for the offence registered under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. Earlier case diary was called for in this case which has been received.
Learned counsel for the petitioner submits that though the petitioner is named in the first information report but no specific role has been attributed to him. He further submits that similarly situated persons have been extended the privilege of anticipatory bail by an order of this court passed in Cri. Misc. No. 45326 of 2015 vide order dated 01.12.2015.
Patna High Court Cr.Misc. No.33234 of 2015 (3) dt.02-12-2015 2/2 Learned counsel for the State also submits that petitioner's case stands on the similar footing as no particular role has been attributed to him.
Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in Saharsa P.S. Case No. 689 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C.
