Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection

Patna High Court CR. MISC. No.28924 of 2021(3) dt.28-02-2022 2/3 with Sasaram (M) P.S. Case No. 03 of 2021, registered for the offences punishable under Sections 341, 323, 435, 379, 504 and 34 of the Indian Penal Code.

At the very outset, learned counsel for the petitioner has withdrawn the anticipatory bail petition in respect petitioner Nos. 1 and 2 against whom there is specific allegation of assault to Rakesh Raj Kumar who have sustained grievous injuries. Accordingly, the anticipatory bail application in respect of petitioner Nos. 1 and 2 is dismissed as withdrawn. So far as rest petitioners are concerned, learned counsel for the petitioner has submitted that there is case and counter case and the petitioners' side have also sustained injuries and in counter case it is alleged that the members of informant's side have committed arson in the house of the petitioners and also ransacked it. Except petitioner Nos. 1 and 2, the allegation against other accused persons are general and omnibus, as such, let the petitioner Nos.

3 to 8 , in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas, Sasaram in connection with Sasaram (M) P.S. Case No.

Patna High Court CR. MISC. No.28924 of 2021(3) dt.28-02-2022 3/3 down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
