JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 323, 341, 386, 435, 379/34 of the Indian Penal Code, Sections 14, 16, 17, 18, 20, 38, 40 of U.A.P. Act and Section 17 of C.L.A. Act.

Petitioner is not named in the first information report and the name of the petitioner came in confessional statement of co-accused. The impugned order goes to show that learned Additional Sessions Judge mentioned in his order that petitioner does have criminal antecedent of several cases but Senior Superintendent of Police, Gaya has reported vide letter no.4203 dated 23.9.2016 that petitioner does not have any criminal

Patna High Court Cr.Misc. No.34215 of 2016 (3) dt.22-10-2016 2/2 antecedent. Moreover, F.I.R. named accused have already been granted privilege of bail.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Gaya in connection with Belaganj P.S.
